1. Introduction and Acceptance

These Terms & Conditions ("Terms") govern your access to and use of pwrwillow.com (the "Site") and any purchase you make from it. The Site is operated by Anaya Communication Private Limited, trading as PWR Willow ("PWR Willow", "we", "us", "our"), with its registered office at IInd Floor Above MGS Tower, Lane No. 10, Industrial Area Phase 2, Gangyal, Jammu – 180010, Jammu & Kashmir, India.

By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

2. Eligibility

You must be able to form a legally binding contract under applicable law to place an order with us. If you are placing an order on behalf of a minor, you confirm that you are authorised to do so.

3. Products and Descriptions

We describe our products, including cricket bats, as accurately as we reasonably can. Product images are representative; because our bats are made from natural Kashmir willow, individual grain pattern, colour, and minor surface texture will vary between bats, and the bat you receive may look slightly different from the exact image shown, even though it is the correct product. This natural variation is not a defect and is described further in our Warranty & Quality Policy.

This natural-variation disclosure does not excuse us from delivering the correct product as described in its material specifications (such as model, weight range, grade, and size), and does not limit any right you have if a product is genuinely misdescribed, defective, or not what you ordered.

4. Pricing and Payment

Prices shown on the Site are in Indian Rupees (₹) unless stated otherwise, and are inclusive of applicable taxes unless stated otherwise at checkout. We reserve the right to correct genuine pricing errors before an order is confirmed; if a pricing error is discovered after your order is confirmed, we will contact you before proceeding; you may then choose to continue at the corrected price or cancel free of charge.

5. Orders and Order Acceptance

Placing an order is an offer to purchase, which we may accept or decline (for example, due to stock unavailability or a suspected error). A contract is formed only once we confirm your order.

7. Account and Security

If you create an account, you are responsible for keeping your login details confidential and for activity that occurs under your account, except where that activity results from our own fault or a security failure on our part.

8. Acceptable Use

You agree not to use the Site to: violate applicable law; infringe any person's intellectual property or other rights; transmit malicious code; attempt to gain unauthorised access to the Site or its systems; or interfere with the Site's normal operation.

9. Intellectual Property

All content on the Site — including the PWR Willow name, logo, product photography, and written content — is owned by or licensed to PWR Willow and is protected by applicable intellectual property law. You may not reproduce, distribute, or create derivative works from this content without our written permission, except as reasonably necessary to use the Site for its intended purpose (for example, sharing a product link).

10. Third-Party Links and Services

The Site may link to third-party sites or services (for example, payment gateways or courier tracking pages) that we do not control. We are not responsible for the content or practices of those third parties.

11. Limitation of Liability

To the maximum extent permitted by applicable law, PWR Willow's liability to you in connection with your use of the Site or a purchase is limited to the amount you actually paid for the relevant order.

This limitation does not apply to, and nothing in these Terms excludes or limits our liability for: fraud or fraudulent misrepresentation; wilful misconduct or gross negligence; death or personal injury caused by our negligence; or any statutory product liability, right, or remedy that cannot lawfully be excluded or limited under the Consumer Protection Act, 2019 or any other applicable law.

12. Indemnification

You agree to indemnify PWR Willow against claims, losses, or expenses arising from your breach of these Terms or your misuse of the Site, except to the extent such claims, losses, or expenses arise from our own fault.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or in applicable law. The "Last Updated" date above reflects the most recent revision. Material changes will be reflected on this page; continued use of the Site after an update constitutes acceptance of the revised Terms, without affecting rights you already have in relation to orders placed before the change.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Subject to your non-excludable right as a consumer to approach the consumer disputes redressal commission or forum having jurisdiction under the Consumer Protection Act, 2019 (or any other competent authority), any dispute arising from these Terms is subject to the jurisdiction of the courts located in Jammu, Jammu & Kashmir.
